Terms of Service

Welcome to PopIn. These Terms of Service ("Terms") govern your access to and use of our mobile applications, website (wepopin.app), and services (collectively, "PopIn" or the "Service") operated by PopIn Inc.

By downloading, registering for, or using PopIn, you agree to be bound by these Terms and our Privacy Policy. PopIn is licensed — not sold — to you under these Terms, pursuant to Apple's Standard Application License Agreement (EULA) available at apple.com/legal. In any conflict between Apple's EULA and these Terms, Apple's EULA governs.

1. Eligibility and Accounts

  • Age Requirement: You must be at least 17 years of age to use PopIn. To start a live broadcast or video stream, you must be at least 18 years of age or older. If we discover a user is under 17, we will immediately delete their account and associated data without notice.
  • Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access.

2. User-Generated Content (UGC) & License

You retain ownership of all content you create and broadcast through PopIn ("Your Content"). By posting or broadcasting Your Content, you grant PopIn Inc. a worldwide, non-exclusive, royalty-free, sublicensable license to use, display, reproduce, and distribute Your Content solely for the purpose of operating and improving the Service.

You represent and warrant that you own or have the necessary rights to Your Content, it does not infringe any third-party intellectual property, and complies with all applicable laws.

3. Copyright Policy & DMCA Takedown Procedure

PopIn Inc. respects the intellectual property rights of others. In accordance with the Digital Millennium Copyright Act ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using our Service.

If you are a copyright owner and believe that any content on PopIn infringes your copyright, you may submit a written DMCA Notice to our designated Copyright Agent at support@wepopin.app containing the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material that is claimed to be infringing and information reasonably sufficient to locate the material (e.g., specific user profile, stream link, or screenshots).
  4. Your contact details: address, telephone number, and email.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner.

Counter-Notification: If Your Content was removed due to a DMCA filing and you believe this was in error, you may file a Counter-Notification to support@wepopin.app specifying your signature, the removed material's location, and a statement under penalty of perjury that the material was removed by mistake or misidentification.

PopIn Inc. maintains a strict Repeat Infringer Policy and will terminate the accounts of users who repeatedly violate third-party copyrights.

4. Zero-Tolerance Policy — Objectionable Content

In compliance with Apple App Store Review Guidelines §1.2, PopIn maintains an absolute zero-tolerance policy for:

  • Child Sexual Abuse Material (CSAM): Any content that sexually exploits, depicts, or endangers minors. Results in immediate permanent ban and mandatory reporting to NCMEC.
  • Graphic Violence & Gore: Depicting real-world graphic violence, animal cruelty, or gore.
  • Hate Speech: Content that demeans or promotes hatred based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, or other protected characteristics.
  • Harassment & Doxxing: Targeted harassment, threats of violence, and sharing private personal information without consent.
  • Self-Harm Promotion: Content promoting, glorifying, or instructing self-harm or suicide.

5. User Tools: Blocking & Reporting

  • Blocking: Users can block other users instantly via the in-app tools (using the "..." menu). Blocking immediately hides all content, comments, and messages from that user, preventing them from entering your rooms.
  • Reporting: Users can report violations using the in-app flag icon (⚑). Our moderation team operates 24/7 and aims to review reports within 24-48 hours. Urgent safety concerns can also be emailed to support@wepopin.app.

6. Virtual Economy — PopCoins & Diamonds

  • PopCoins: Virtual, in-application currency purchased exclusively through Apple's In-App Purchase system. PopCoins have no monetary value, cannot be exchanged for cash, and are non-refundable. Refund requests must be submitted directly to Apple.
  • Diamonds: Virtual rewards received when users send you gifts. Diamonds may be converted to real-world earnings through the Creator Monetization Program, subject to minimum thresholds.
  • Forfeiture: Upon account deletion or permanent suspension for Terms violations, all PopCoin and Diamond balances are immediately and permanently forfeited without refund.

7. Camera & Microphone Access

The App requests camera and microphone access solely for enabling live video broadcasting, video calling, and profile photo capture. We do not access, record, or transmit camera or microphone data when you are not actively engaged in a live broadcast or video call session.

8. Disclaimers & Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, POPIN INC. AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

9. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States. Any disputes not resolved informally within 30 days shall be submitted to binding individual arbitration under the American Arbitration Association's Consumer Arbitration Rules. You waive any right to participate in class action proceedings.
